Updated everything including the BIOS to rev3 the system is still very unstable. Surprise surprise New Egg says you only have 30 days to return it. Gigabyte RMA process can take upwards of a month, I don't have the budget for a new mobo so I'm up a creek without a mobo. Other Thoughts: My system worked perfect for about a month and is now unstable.

I get BSOD stop errors 'PFN List Corrupt' & 'DRIVER_IRQL_NOT_LESS_OR_EQUAL' from the realtek rtlh86.sys driver, also on reboots i get 'BIOS CHECKSUM ERROR'. When the system crashes it will not boot on a restart alone. It will only boot cold. It has to be shutdown all the way and then turned on. I have loaded the updated drivers (from the gigabyte website) for every component (Audio,NIC, CHipset), rolled back drivers and tried the drivers on the provided CD.

I have flashed the BIOS and run memtest for hours on the installed ram simms on this system and others and it has passed without issue or incident. The software change was an update to the new version of itunes before the trouble started and the installation of the game 'Grid' for PC. Both pieces of software carry the windows vista seal so they should be fine. I have no unsigned drivers and have run verifier after every update to make sure.
